Predictions for Legislation and Regulation in 2018

The year 2018 projects to be an interesting one in the halls of the United States Congress. As the majority party in both chambers, Republicans will continue to work to carry out President Trump's agenda, including a broad infrastructure plan, immigration reform, and border security. Lawmakers will also work towards passing a budget resolution funding the federal government for the remainder of the fiscal year, as opposed to short-term continuing resolutions that maintain current spending levels, and lifting caps on allotments for the military. Patients Rights Notice Update
CMS has confirmed that the new Patient Rights Notice as described in §484 50(a) must only be provided to patients admitted onto service on or after January 13, 2018. However, the transfer/ discharge policy and the administrator contact information must be provided to current patents. CMS’ rationale is that the contact information and discharge/transfer policies are completely new requirements, and providing them to patients would not be a duplication of efforts already completed.
RAC (Recovery Audit Contractor) to Begin a Home Health Complex Review

In 2016, CMS awarded Performant Recovery, Inc. to be the Recovery Audit Contractor (RAC) for Region 5. The Region 5 RAC is dedicated to the post payment reviews of DMEPOS and Home Health/Hospice claims nationally. Performant has been focused primarily on DMEPOS reviews, however, on 1-10-18, they received approval from CMS to begin a home health complex review for documentation and medical necessity with affected revenue codes of: 027X, 042X, 043X, 044X, 055X, 056X, 057X. Claims submitted in the past 3 years can be chosen for this review. If your agency is selected for a review, Performant will send the ADR request via first class mail. Once a provider receives an ADR from Performant, they will have 45 calendar days to submit the medical records.

As the Conditions of Participation are written, ALL home health aides (current and new) must show competency in a tub bath and shampooing in bed and a tub before they can be given any assignment in the field, and these must be evaluated by observing an aide’s performance of the task with a patient. We are trying to understand the impact of these competency requirements and are very concerned that many home care aides may not be available to provide services with revisions to the HHCoPs and the requirement for certain competencies to be observed on a patient.
